The Annual Trafficking in Persons Report was presented today.


For the first time, it also includes a ranking of the United States based on the same standards applied for other countries. 


Hillary Rodham Clinton: "This year’s report highlights several key trends, including the suffering of women and children in involuntary domestic servitude, the challenges and successes in identifying and protecting victims, and the need to include anti-trafficking policies in our response to natural disasters, as was evident in the aftermath of this year’s earthquake in Haiti."

Entra a la consulta del médico con un bebé en los brazos. Cualquiera diría que el bebé es su hermano pequeño pero en realidad es su hijo. No tiene más de catorce años, no puede tenerlos, es una niña, su cara, su cuerpo, su forma de hablar. Dice que no tiene pareja pero viene a por métodos de planificación familiar. Es refugiada, menor y ha pasado por todos los circuitos de organizaciones que trabajan en la asistencia a migrantes subsaharianas. Poco después nos enteramos que tiene un compañero, como quince años mayor que ella. Es su pareja, su marido, su vida en Marruecos. En España sería pedofilia, aquí es subsistencia.

Recomendaciones de Amnistía Internacional al Proyecto de Ley Orgánica por la que se modifica el Código Penal

El pasado jueves, se aprobó en el Senado el Proyecto de Ley de Reforma del Código Penal en España.


La responsable de Política Interior y Derechos Humanos de Amnistía Internacional, Virginia Álvarez, ha manifestado su "profunda decepción" ante la aprobación de dicho proyecto.

Según Amnistía Internacional, entre otras cuestiones, resulta también preocupante que el proyecto no haya tenido en cuenta las recomendaciones específicas dirigidas a las autoridades españolas por los comités que vigilan el cumplimiento de tratados internacionales y siga sin adecuarse la legislación interna a las obligaciones internacionales, en particular en lo que se refiere a crímenes de lesa humanidad, desaparición forzada, ejecuciones extrajudiciales, la tortura o la trata de personas.

En un comentario exclusivo para este blog, la responsable de Política Interior comenta respecto a trata, que se ha incluido la definición de trata de acuerdo a normativa internacional, "pero desde AI además pedíamos que se incluyese en primer lugar dentro de la parte de crímenes internacionales, incluyendo la imprescriptibilidad ya que está dentro de delitos ordinarios, se adecuaran la penas a la gravedad del delito y se incorporara como infracción la utilización de servicios cuando a sabiendas se supiese que es una víctima de trata de seres humanos. El CP tampoco regula delitos contra los derechos sexuales y reproductivos como delitos autónomos, como es el caso de embarazo forzado, esterilización forzada, ni los adecua completamente a la definición internacional."

Costa Rica presenta: Ley contra la trata de personas

La ley establece un programa de atención y protección de víctimas

Consideraciones sobre la protección integral para víctimas de trata en Costa Rica.

En Costa Rica se presentó el proyecto de "Ley contra la trata de personas", el cual establece penas de cárcel para los tratantes, crea un instituto especializado en el asunto y establece un programa de protección de víctimas. El proyecto ingresó al Congreso costarricense el pasado jueves y fue presentado también a la prensa y diputados, en una actividad en la que los legisladores de distintos partidos ofrecieron su apoyo a la iniciativa para una futura votación.

El proyecto también establece un programa de atención y protección de víctimas, y crea el Instituto Nacional contra la Trata de Personas, adscrito al Ministerio de Seguridad, el cual se encargará de elaborar y poner en práctica un plan nacional contra la trata de personas.

España expulsa a mujer embarazada amenazada de muerte.

España: La Red Española Contra la Trata de Personas denunció que las autoridades negaron el  reconocimiento del derecho al período de restablecimiento y reflexión a una mujer embarazada que estaba siendo explotada sexualmente. La Delegación del gobierno y el Ministerio del Interior señalaron en su momento, que en todo momento se respetaron los derechos de la mujer y que no les constó que estaba amenazada de muerte. El Ministerio del Interior, desoyó al Defensor del Pueblo y ACNUR y expulsó la mujer.

ACNUR expresó su preocupación ante la expulsión. Según el comunicado de prensa, la mujer solicitó asilo ante las autoridades españolas y su peticion fue denegada, pese a los informes favorables a la admisión al procedimientos emititod por ACNUR.

Council conclusions on unaccompanied minors

Justice and Home Affairs Council published the conclusions of its latest meeting in Luxembourg concerning the issue of foreign unaccompanied minors.

The Council called on the European Commission and all member states to improve the level of knowledge of all stakeholders, the quality of reception and procedural guarantees. It also addressed issues raising many concerns in the EU action in third countries.

Particularly, the Council encourages the commission to support the authorities of countries of origin in managing return, by creating reception centres that can provide care for minors returned when the family cannot be found to facilitate the reintegration of the minors in their social and cultural environment while guaranteeing the respect of their best interest, clearly in contradiction with recognized international children rights recommendations and principles.

New Saudi marriage contracts to ask the bride's age

The new measures have been welcomed by human rights activists

Saudi Arabia has started issuing new marriage contracts that require the age of the bride to be given, in an attempt to stop underage girls from marrying.

The kingdom had promised new measures after a series of high-profile cases involving young brides.

Human rights groups have welcomed the new measures, saying clear-cut rules were needed to ensure underage girls were not harmed.

Saudi Arabia has no law against child marriage.

GENEVA - “Trafficking in persons -one of the most appalling forms of human rights’ violations- remains one of the fastest growing criminal activities in the world, and the role of regional organizations fighting against it cannot be underestimated,” UN Special Rapporteur Joy Ngozi
Ezeilo said on Thursday, before presenting her annual report* on trafficking in persons, especially women and children, to the Human Rights Council.

“While better cooperation among countries of origin, transit and destination is key to address this scourge,” the independent expert said, “the role of regional and sub-regional organizations in catalyzing the action of States in combating trafficking in a specific region has not received sufficient attention and support.”

BEYOND BORDERS: TRAFFICKING IN THE CONTEXT OF MIGRANT, LABOUR AND WOMEN'S RIGHTS

Over time, GAATW has become increasingly aware and concerned that discussion at policy and advocacy levels on trafficking, migration, labour, gender, and globalisation issues continue to be fragmented into specialist discussions even though it is clearer than ever before that any one single framework is unable to address the range of human rights violations people experience during labour migration processes. The challenge that civil society faces now is to appreciate and utilise the overlaps and intersections between anti-trafficking frameworks with migrant rights, labour rights and other sister movements, and thus enable civil society actors to work with each other more effectively for the human rights of all migrants and all workers.

This year's conference will bring together a diverse group of human rights advocates working in a broad range of fields, relating to trafficking, women's rights, migration and labour issues, to discuss the practical and conceptual linkages between trafficking and migration, gender, labour and globalisation and to suggest future strategic directions for a broad range of civil society actors. Prior to the conference, GAATW will convenea Members Congress that will discuss GAATW's strategic direction in the coming years and other organisational matters.
