ARGENTINA: SE APROBÓ LEY QUE CONDENA LA TRATA

Diputados aprobó la modificación de la ley de trata

En una sesión extraordinaria convocada por el Ejecutivo, la Cámara baja convirtió en ley por 224 votos a favor y una sola abstención el proyecto que modifica la ley sobre prevención y sanción de la trata de personas que ya contaba con media sanción del Senado. Ayer el texto había recibido el apoyo unánime de todos los bloques en un plenario de comisiones que se extendió por poco más de dos horas. Al cierre del debate, el jefe del bloque oficialista, Agustín Rossi, coincidió con su par radical, Ricardo Gil Laavedra, en que todavía falta "un debate cultural" acerca de la falta de condena social a la prostitución y acerca de la costumbre de "pagar por sexo", y le reclamó a la Justicia que considere los testimonios de las víctimas de trata de la misma manera en que se consideraron los testimonios de las víctimas del terrorismo de Estado que hicieron posibles los juicios por los crímenes de lesa humanidad de la última dictadura cívico militar.


El dictamen único fue encabezado por las firmas de los diputados del oficialista Frente para la Victoria. Los bloques opositores acompañaron,
aunque cuestionaron los motivos que llevaron a que el tema debiera ser incluido en extraordinarias. El debate del proyecto fue incluido en el temario de convocatoria a sesiones extraordinarias del Congreso enviado la semana pasada por el Poder Ejecutivo, luego de conocerse el fallo de la justicia tucumana que absolvió
a los 13 acusados por el secuestro y desaparición de Marita Verón, víctima de una red de trata de personas.

Tras ese fallo, la presidenta Cristina Fernández de Kirchner se comprometió "a seguir acompañando" a Susana Trimarco, la mamá de Marita, en la lucha
contra los responsables de la trata de personas.

El proyecto que recibió dictamen ayer cuenta con media sanción del Senado y contempla ampliar las condenas para los delitos de explotación sexual simple
entre 2 y 4 años, mientras que establece penas de prisión de 5 a 15 años cuando las víctimas hubiesen quedado embarazadas o fueran menores de edad.

Para las víctimas que tienen que testificar en un juicio, la nueva propuesta modifica el Código Procesal Penal para que las declaraciones sean realizadas por un psicólogo designado por el tribunal y en ningún caso por las partes.

Otro de los puntos principales de la modificación es que el consentimiento de la víctima no constituirá en ningún caso causal de eximición de responsabilidad penal para los autores del delito.

Perú - Publicaciones sobre trata de personas y tráfico ilícito de migrantes

Tenemos el gusto de invitarles a la presentación de las dos últimas publicaciones de la organización CHS Alternativo. (Invitación adjunta)
 
-          Tercer Balance sobre la Implementación de la Ley 28950: ley de la trata de personas. Presenta los principales avances en el desarrollo de las políticas públicas contra la trata de personas y el tráfico ilícito de migrantes, a través de un recuento de las acciones del Estado relacionadas a la prevención, persecución y asistencia a  las víctimas durante el periodo mayo 2010 -mayo 2012.
-          Trata de personas: agenda pendiente 2013-2016. Este libro recoge la agenda pendiente para los próximos años en el enfrentamiento a la trata de personas en el Perú.
