Fundación Esperanza analiza los Informes del Departamento de Estados Unidos sobre Trata de Personas

Les compartimos el análisis que hicimos como Fundación ESPERANZA de los informes anuales que sobre la trata de personas hace el Departamento de Estado de los Estados Unidos. Estos informes se emiten desde el año 2001, y con motivo de una visita que hizo una delegación Departamento de Estado de los Estados Unidos a Colombia, encabezada por la señora Nan Kennelly oficial encargada del monitoreo y combate al tráfico de personas, y Sara E. Gilmer encargada de los reportes en el hemisferio occidental,  y que visitaron nuestras oficinas. Desde la embajada  nos pidieron  previamente un análisis sobre el reporte del año 2011.

Como Fundación ESPERANZA nos dimos a  la tarea no solo de analizar el reporte del año 2011 sino también de los 10 años previos, y partir de allí tener una mirada más global de la política pública colombiana en materia de trata de personas.

Les compartimos este documento con el propósito de contribuir a la reflexión y al debate sobre la política pública en materia de migración y trata de personas.

SOUTHERN AFRICA: Counter-trafficking measures trail commitments

JOHANNESBURG, 12 December 2011 (IRIN) - At any given time, an estimated 130,000 people in sub-Saharan Africa are engaged in forced labour as a result of trafficking. It is a fraction of the global figure, which the International Labour Organization (ILO) puts at 2.5 million, but this highly lucrative and concealed crime is on the rise in Africa and traffickers usually operate with impunity. 

Southern Africa has many of the conditions traffickers capitalize on: endemic poverty and unemployment that create a demand for better opportunities, and high rates of regular and irregular migration that mask the movements of traffickers and their victims.

The region has no shortage of protocols, frameworks and action plans for dealing with human trafficking, but the net result of all these agreements has been no more than a handful of prosecutions.

"African countries are more than happy to sign documents and attend conferences, but step out of the room and they're happy to have lunch and forget about it," said Ottilia Maunganidze, a researcher on the International Crime in Africa Programme at the Institute for Security Studies in Pretoria.

Maunganidze was addressing a roomful of experts and government officials mainly from the Southern African Development Community (SADC) who gathered in Johannesburg, South Africa, recently to look at ways of turning commitments to counter human trafficking into action.

The key international framework for combating this crime is the 2000 UN protocol to prevent, suppress and punish trafficking in persons, also known as the Palermo Protocol [ http://www2.ohchr.org/english/law/protocoltraffic.htm ]. Its lengthy definition of human trafficking includes "the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception.for the purpose of exploitation." Twelve of the SADC's 15 member states have ratified the protocol, which committed them to enact legislation to make human trafficking a criminal offence.

More than a decade later, only six have passed comprehensive laws. Several others have partial laws or, in the case of South Africa, bills waiting to be passed [ http://www.irinnews.org/report.aspx?ReportId=93104 ], while five countries lack any specific legislation.

"If trafficking is not a crime in your country, everything else is symptomatic," warned Johan Kruger of the UN Office on Drugs and Crime (UNODC).

Maunganidze pointed out that merely passing legislation is not enough. Mozambique has passed legislation, but has never prosecuted a case. "Criminalisation has to happen in practice," she told the meeting.

This means developing national action plans that involve social workers, medical professionals, public prosecutors and the police; establishing a central anti-trafficking unit; allocating resources to assisting victims; and signing bilateral and multilateral agreements with the countries victims originate from and pass through.

SADC countries adopted a 10-year strategic plan of action to combat trafficking in persons in 2009 that incorporates many of these measures. There is also a protocol on gender and development with a deadline of 2015 to put in place measures to eradicate trafficking. Maunganidze says this is "probably very idealistic", and cites the difficulty of identifying and addressing some of the root causes of trafficking, as well as the limited resources and political will so far devoted to responses.

Most trafficking in southern Africa is for the purpose of sexual exploitation, but trafficking for forced labour is growing and is even more hidden, according to Bernardo Mariano-Joaquim, regional representative of the International Organization for Migration (IOM).

Criminal syndicates are usually engaged in these activities, and many people still lack a clear understanding of what trafficking is, adding to the difficulty of detection and prosecution. "Organized crime can't be prosecuted in the same fashion as other crimes," said Kruger. "You have to connect the dots, you need proactive intelligence and international cooperation."

"In Africa, we're making some progress in creating an environment to assist victims, but where we need more work is prosecutions," Mariano-Joaquim told IRIN. "Prosecution is lagging behind the identification of victims, and even prevention."

Se le acusa, junto a otros compinches, de traer a compatriotas rumanas con la promesa de un trabajo y forzarlas a prostituirse

La banda de ciudadanos rumanos liderada por Ioan C., alias  'cabeza de cerdo', será juzgada el próximo martes acusada de traer a España a jóvenes compatriotas con la falsa promesa de darles un trabajo, aunque en realidad las obligaban a ejercer la prostitución.En el banquillo de los acusados se sientan junto a Ioan C. otras nueve personas -Monika V., Tanifidis B., Nicolai I., Daniel S., Stan J., Druga B., Gheorge D., Gheorge C., y Marius A.V.- y a todos se les imputan cuatro delitos de prostitución y un delito de prostitución de menor, así como un delito de aborto para tres de ellos. 

En su escrito provisional, el fiscal solicita penas de prisión de entre 20 y 28 años y el pago de hasta 30.000 euros a cuatro víctimas, que se presentan en el juicio como testigos protegidos. Los hechos se remontan al año 2000 cuando, según el Ministerio Público, los procesados consiguieron que varias compatriotas de nacionalidad rumana viniesen a España con la creencia de que iban a proporcionales un trabajo. Una vez aquí, las obligaban al ejercicio de la prostitución -en la Casa de Campo, según la Policía- para saldar  la deuda con la organización por los gastos de su traslado. 'Cabeza de cerdo', en su calidad de jefe, era quien dirigía y controlaba a las mujeres gracias a la colaboración del resto de procesados, quienes realizaban los traslados al lugar donde desempeñaban la prostitución y les obligaban a entregar el dinero obtenido. Una de las víctimas, menor de edad ya que tenía 17 años en 2000, se quedó embarazada y Ioan C. le obligó a que acudiera a la clínica El Bosque para que le practicaran un aborto en su quinta semana de embarazo. Monika V. y Tanafidis B. fueron las personas encargadas de acompañar y vigilar a la menor el día que acudió a la clínica, añade el fiscal. 

Ioan C. se entregó el pasado mes de junio porque, según informó entonces la Policía, estaba presionado porque su imagen había sido difundida en el canal de las Fuerzas de Seguridad en internet www.youtube.com/policia y su nombre estaba incluido en la lista de los fugitivos más buscados. 'Cabeza de cerdo' está reclamado por Rumanía e Italia, acusado de los delitos de tráfico de seres humanos y de narcotráfico, respectivamente.

España - Ecuador: Los migrantes planean retorno

La Secretaría Nacional del Migrante (Senami) y la Asociación Rumiñahui, que concentran a más de 12 mil ecuatorianos en España, informaron que en los últimos cinco años retornaron  17  mil ecuatorianos desde esa nación ibérica. En la actualidad, cerca de 700 mil compatriotas tienen la calidad de migrantes en España.
 
Sin embargo, las alternativas para lograr su ‘reinserción’ en el país, a través de Plan Retorno y Cucayo, no cubren en las proporciones que los migrantes necesitan, aseguró Vladimir Paspuel Revelo, presidente de la Asociación Rumiñahui.

Uno de los principales inconvenientes se registran en la Aduana por la falta de crédito para inversión y en el mal uso que le dan ciertos migrantes al traslado del menaje de casa y empresa, añadió Pasquel.
Las asociaciones de ecuatorianos en España informan que los compatriotas que laboran en ese país  reciben hasta el 35% menos del salario que perciben los españoles.

Por ejemplo, los campos de desarrollo de la mano de obra en las tres áreas de mayor desempeño como el servicio doméstico reciben entre 500 y 600 euros al mes (antes de la crisis el monto superaba los 800 euros).
Una situación similar ocurre  en el sector de  la construcción en donde ganan 800 euros (antes entre 1.500 y 3.000) y por las labores de agricultura entre 600 y 900 euros (antes entre 1.000 y 1.300).

La crisis en España, dijo Pasquel,  generó dos fenómenos: el primero  fue una migración transnacional, es decir, que los ecuatorianos con calidad de residentes viajan a otros países en búsqueda de nuevo empleo. Un segundo punto es el  reciclaje laboral que se refiere al acceso que tienen las personas con   mayor capacitación y  manejo de  idiomas. El sector con mayor vulnerabilidad es el de quienes no tienen estudios o no hablan más de un idioma, en éste grupo están la mayoría de los obreros de la construcción.

El retorno de ellos es casi inminente,  concluyó Pasquel,  quien aseguró que para ayudar a los ecuatorianos  a través de un fondo europeo se prevé entregar pasajes aéreos de retorno, una colaboración de 400 euros y a quienes tengan un proyecto de trabajo en Ecuador 1.600 euros, más 400 de manutención.

Proyectos

Ante la disminución de los salarios, quienes regresan al Ecuador plantean la consolidación de asociaciones o proyectos que les permita mantener ingresos y generar  empleo para otros ecuatorianos, añadió Gloria Aguirre, dirigente  de la Asociación Amas de Casa.

Aguirre  añadió  que son  muchos los ecuatorianos que están ‘parados’ sin trabajo y que quieren regresar al Ecuador, pero no tienen para comprar un boleto de regreso que, dependiendo de la temporada puede variar entre los 500 y 1.000 euros.

La Asociación cuenta en Pimampiro (Imbabura) con un restaurante en el cual trabajan mujeres que retornaron a Ecuador.

Para desarrollar este proyecto comunitario se necesitaron   fondos de ONG’s  para abrir un restaurante de comida ecuatoriana.

The 16 Days of Activism end on 10 December (International Human Rights Day), and during this time we will highlight 16 key facts on intimate partner and sexual violence against women.

Physical and/or sexual violence by an intimate partner

Fact 1: Up to 70% of women experience physical and/or sexual violence by an intimate partner at some point in their lives.

The WHO multi-country study on women’s health and domestic violence against women indicated that intimate partner violence is widespread across many societies. The study showed that rates of physical and/or sexual violence by an intimate partner ranged from 15% in Japan, to 70% in Ethiopia and Peru, with most sites reporting rates of between 29 and 62%. COMO SIEMPRE: no se sabe ni se menciona qué pasó con las víctimas. ¿Fueron derivadas a servicios de atención y asistencia? ¿Donde y como fueron asistidas? ¿Acogidas? En España casi no hay servicios especializadas para hombres víctimas de trata. ¿Se les ofreció periodo de reflexión?...

   Agentes de la Policía Nacional han desarticulado un grupo dedicado a la explotación sexual de hombres en un piso de Madrid. Eran captados a través de las redes sociales en Brasil y engañados con falsas promesas acerca del trabajo que iban a desempeñar en España.

Las mafias chinas se especializan en la explotación sexual

Como suele pasar normalmente: se informa sobre las redes, el trabajo investigativo de la policía, etc... pero nada de qué pasó con las víctimas. 
¿Cuantas fueron acogidas? ¿asistidas? ¿protegidas?...

Barcelona (ACN).- Dos de las operaciones policiales más ambiciosas de los Mossos d'Esquadra han estado contra la mafia china. Hace dos años y medio contra el grupo criminal que explotaba trabajadores en talleres textiles de Mataró y hace dos meses contra una red que obligaba a prostituirse a un centenar de mujeres encadenadas a ofrecer servicios sexuales sin descanso y sin preservativo.


En ambos casos las víctimas eran también de nacionalidad china. El comisario de la División de Investigación Criminal, Josep Lluís Trapero, explicó, en declaraciones a la ACN, que la mafia china ha ido penetrando "poco a poco" en la sociedad catalana en actividades delictivas relacionadas con la explotación "laboral y sexual".
